Sales or Lease Agreement

All prices indicated for the domains listed on ActivaDomains.com are indicative prices only subject to negotiation. Domain purchases become binding upon mutual agreement in writing. Any Leasing agreements are by mutual negotiation and agreement.

The payment process for an agreed sale is dependant on the value of the domain purchased. For lesser value domains, payment is to be made by paypal as agreed between the parties. Larger value domains will use an escrow service such as escrow.com for the security of both parties. The use of other payment processes may be made as agreed between the parties. Our policy is to split any escrow costs between the buyer and seller. Any costs relating to the transfer to another registrar is the responsibility of the buyer. Specific details relating to the payment will be provided when a sale is agreed. Payment terms for domain leases are by agreement between the parties.

All prices quoted and agreed between you and Activa Domains is understood to be inclusive of any applicable taxes. All domains prices listed are denominated in Euros (€), any agreement is subject to current exchange rates ruling at the time and as agreed between the parties in writing.

Some domain extensions are subject to restrictions for individuals or companies outside a geographic area. It is your responsibility as buyer to ensure that you are in compliance with all rules, regulations and laws applying to domain extensions for which you submit an offer.

Both parties endeavour to complete the sales transaction within a reasonable timeframe. The timing of any transfer is contingent on the transfer policy of both the current registrar and the gaining registrar. Both parties agree to use best efforts in completing any sale. Unless previously agreed in writing, should Activa Domains determine, in its own judgement, determine that there has been an unreasonable delay in concluding the sale, it may withdraw the sale offer at its own discretion.

The buyer agrees that it will hold Activa Domains harmless for any delay in tranfer provided that such delay is not a result of intentional wrongdoing or gross negligence by Activa Domains. Both parties agree that once a transfer has been initiated, neither party may seek cancellation of such transfer unless agreed in writing by both parties.

Existing Websites & Content

Some of our domains relate to an existing website and content. Any price agreed for sale or lease of the domain includes the transfer of the current website and content.

Trademark & Conflicting Rights

Activa Domains endeavours to only sell quality generic domain names however it does not provide any warranty in any way regarding the existance of any conflicting rights relating to, but not limited to, trademark rights, violation of law, copywrite in any form for any of its domains. It is the duty of the buyer to ensure there are no conflicting rights or violation of applicable law of any nature whatsoever. If you believe one of our domains is in conflict with an existing right or trademark that you have, please contact info@activadomains.com and we will investigate this issue.

Other

Activa Domains cannot guarantee that you will be provided with uninterrupted access to this site at all times.
